      • DayLyte, Inc's services may only be used for lawful purposes. DayLyte, Inc expressly forbids the transmission of any material which would violate any Federal or State law.
      • DayLyte, Inc makes no warranties of any kind, whether expressed or implied, including warranties of merchantability or fitness for a particular purpose. DayLyte, Inc accepts no responsibility for the accuracy, quality or suitability of information obtained through its services.
      • DayLyte, Inc prohibits attempts to bypass its pricing structure by any means.
      • DayLyte, Inc reserves the right to change the Payment Terms by notifying you 30 days in advance of the effective date of change.
      • DayLyte, Inc reserves the right to modify any of these terms and conditions at any time as the need arises.
      • DayLyte, Inc reserves the right to cancel any or all levels of service at its discretion. Should this occur for any reason except for violations of these Terms and Conditions, accounts will be refunded on a prorated basis. All other cancellations will be effective at the end of your billing period.
      • You Agree to indemnify and hold harmless DayLyte, Inc and its owners from all claims which are a result of your usage without limitation.
      • You agree that the security of your account, including your password is your responsibility and that all use which emanates from your account will be considered to be undertaken by you.
      • You agree to keep DayLyte, Inc informed of your current legal mailing address and current billing information. DayLyte, Inc may contact you via your E-Mail address for any reason, including but not limited to policy changes, special promotions, and announcements.
      • Any or all of these Terms and Conditions may be altered or superseded at any time by DayLyte, Inc by posting it on this web page.
      • SENDING UNSOLICITED COMMERCIAL OR BULK E-MAIL: DayLyte, Inc will not allow any client to send SPAM (also known as Unsolicited Commercial E-mail or Unsolicited Bulk E-mail) through their systems. Violators of the policy are subject to having their accounts immediately terminated with no refund of unused fees paid to DayLyte, Inc.
      • USE OF YOUR E-MAIL ACCOUNT TO RECEIVE RESPONSES FROM YOUR SENDING UNSOLICITED COMMERCIAL OR BULK E-MAIL: DayLyte, Inc will not allow any client to use their DayLyte, Inc provided e-mail addresses to receive responses generated from the client sending SPAM (also known as Unsolicited Commercial E-mail or Unsolicited Bulk E-mail) through their systems or other company's systems. Violators of the policy are subject to having their accounts immediately terminated with no refund of unused fees paid to DayLyte, Inc.
      • RECEIVING UNSOLICITED COMMERCIAL OR BULK E-MAIL: DayLyte, Inc will make every attempt within their means to limit their clients exposure to UCE/UBE. However it is impossible to entirely eliminate all UCE/UBE. All computer systems that are identified by DayLyte, Inc and selected SPAM blacklists agents (such as SPAMCOP.NET) as a sender of UCE/UBE will be denied approval to send e-mail to DayLyte, Inc's servers. In addition, since ~90% of all SPAM received by DayLyte, Inc originates from outside the United States of America, DayLyte, Inc will reject all e-mail originating from outside the United States of America. It should be noted that you may not be able to receive e-mail from certain individuals/companies due to the effects of DayLyte, Inc's SPAM blocking techniques.
      • FAMILY FRIENDLY E-MAIL: In conjunction with the pervious paragraph, DayLyte, Inc will make every attempt within their means to limit their clients exposure to e-mail not suitable for children under 18. This includes, but is not limited to: Pornography (adult-oriented), Obsenity, Illegal, and other Objectionable material. However it is impossible to entirely eliminate such e-mail. All computer systems that are identified by DayLyte, Inc as a sender of such e-mail will be denied approval to send e-mail to DayLyte, Inc's servers. It should be noted that you may not be able to receive e-mail from certain individuals/companies due to the effects of DayLyte, Inc's e-mail blocking techniques.
      • Use of any of DayLyte, Inc's service constitutes acceptance of these Terms and Conditions.
      • Any and all attorney fees resulting in regard to these terms and conditions will be paid by you, the subscriber.
